Terms of Service

Pineapple Play Date (the "service") is the product at https://pineappleplaydate.com. It is operated by [Company legal name] ("we", "us"). Our mailing address is [Mailing address].
These terms are a draft for a lawyer to review before they are treated as final. They are the rules for hosts, guests, and anyone else who uses the service. If you do not agree, do not use it.
Adults only
The service is for adults. You must be at least 18 years old. You must also be old enough to use this kind of service where you live. Some places set that age above 18. You promise that you meet both tests.
We do not check passports or IDs inside the app. A host is expected to confirm age in person before the event. You also confirm in the app that you are 18 or older. That confirmation is not a substitute for the host's own check.
The service coordinates matching
The service helps a host run a private evening for people the host invited. Guests can answer yes or no in private. A match is shown when the answers line up under the rules of that event. Everyone in the room can learn the result at the same time.
The service only coordinates that matching. It does not arrange, supervise, or guarantee anything that happens offline. It does not promise that a match will happen, that a particular person will attend, or that an evening will feel a certain way. Meeting, touching, or doing anything else in person is between the people who are there.
Accounts
You can sign in with an email link. If Google sign-in is turned on for this site, you can also sign in with Google. We do not offer Apple sign-in.
You are responsible for the email account and the Google account you use. Tell us if you think someone else is using your sign-in. You can sign out in the app.
One person, one account. Do not share your account, and do not pretend to be someone else.
Consent
The service is for consenting adults. You decide whether to join, whether to say yes, whether to check in, and whether to stay.
You can change a yes or a no until the host's swipe deadline. After that, answers lock. Skipping check-in is a way to decline the evening. You can withdraw consent for anything in person at any time, including after a match is shown. A match on the screen is not consent to anything offline.
Your own partner is not shown in your cards. You are not paired with someone who did not also say yes, under the rules of that event type.
Hosts
If you host, you are responsible for the event in the real world. That includes:
- The venue, and permission to be there.
- Following the laws where the event happens, including laws about gatherings, alcohol, and adults-only spaces.
- Confirming, offline, that every guest is an adult.
- Writing house rules in your own words, and giving guests a chance to agree before they swipe.
- Deciding who is invited, who is checked in, and whether the group chat stays open.
- Co-hosts you add. They can see the same host tools you can, including swipes.
The service gives you tools. It does not run the door, the room, or the people. A test party is a practice copy with fake guests. It does not send email or push. Deleting your account does not delete a party you host. Delete a test party from the host tools if you want that party gone.
Rules for everyone
You will not:
- Use the service if you are under 18, or under the age required where you live.
- Invite, admit, or depict a minor.
- Post or send sexual content of someone without their consent, or any sexual content of a minor.
- Share another person's photos, messages, name, contact details, or other private information outside the service.
- Harass, threaten, stalk, or out someone.
- Offer, ask for, or arrange commercial sex or paid solicitation.
- Use the service for anything illegal.
- Create a fake profile, or use a photo of someone who is not you, unless a host is clearly using a labeled test party.
We can remove content and end access when we believe these rules were broken.
Your content
You keep ownership of the text and photos you submit. You give [Company legal name] a limited license to host, store, back up, and show that content only as needed to run the service. That includes showing a profile to people in the same event, showing host tools to the host and co-hosts, and keeping a copy so the product works.
The license ends when the content is deleted from the live service, except for copies that remain in a backup for the backup's normal life, and except for content other people already received inside the product. We do not get a license to sell your photos or to use them in ads.
Photos, chat, and confidentiality
Profiles can hold up to 5 photos. Group chat can hold messages, photos, and reactions. A host can turn on a timer that hides messages, view-once photos, or deletion of chat after the party. Those tools reduce how long a message stays visible. They are not a promise that nobody saved it.
You will not screenshot, photograph, download, forward, or otherwise share someone else's photo, profile, swipe, match, or chat. Other guests and hosts are expected to follow the same rule. We cannot technically stop a screenshot. If we learn that someone shared private material, we can suspend them.
Chat is not end-to-end encrypted. See the privacy policy for what that means.
Delete your account
In the app, open Settings, then Delete account. You must type DELETE to confirm. You can also email privacy@pineappleplaydate.com.
What deletion does, and what it leaves in place, is described in the Privacy Policy. Read that section before you delete. A party you host is not deleted with your account.
Suspension and ending
We can suspend or close an account, remove a guest from an event, or stop the service, if these terms are broken or if we need to protect someone. A host can also remove a guest from their own event.
You can stop using the service at any time. Sections that should survive will survive, including ownership of content you already shared inside an event, the limit of liability, indemnity, and the dispute terms.
Disclaimers
The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim warranties of merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We do not warrant that the service will be error free, private from every other guest, or safe to rely on for an in-person decision.
Assumption of risk
You understand that meeting adults, in private, for a sexual or social evening has risks. Those risks include illness, including sexually transmitted infection, pregnancy, injury, emotional harm, and conduct by other people that we do not control.
You assume those risks. You are solely responsible for your own conduct, for the consent you give or withhold, and for how you treat other people. Other users are solely responsible for theirs. We are not responsible for what happens at a venue or between guests after a match.
No medical advice
Nothing in the service is medical, legal, or safety advice. We do not collect lab results, and we do not verify health status. Talk to a qualified professional for health questions. In an emergency, contact local emergency services. A "need the host" button tells the host that a checked-in guest wants them. It is not a medical or police service.
Limit of liability
To the fullest extent the law allows, [Company legal name] and its directors, officers, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or personal injury arising from an offline meeting.
If we are found liable, our total liability for a claim relating to the service is limited to the greater of 100 US dollars or the amount you paid us for the service in the three months before the claim. The service does not currently charge a fee. Some places do not allow these limits. In those places, the limit applies only as far as the law allows.
Your promise to cover us
You will indemnify and hold harmless [Company legal name] and its directors, officers, and contractors from claims, damages, losses, and reasonable legal costs arising out of your content, your event, your conduct, or your breach of these terms. This includes a claim that you admitted a minor, shared someone's private photo, or broke the law at an event you hosted or attended.
Disputes and arbitration
Please email legal@pineappleplaydate.com first and give us a chance to resolve a dispute informally.
Except where the law forbids it, you and [Company legal name] agree that any dispute, claim, or controversy arising out of these terms or the service will be resolved by binding individual arbitration, and not in court, except that either of us may go to small claims court if the claim qualifies. The arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Texas, or by phone or video if the rules allow. The arbitrator can award the same individual relief a court could, and will issue a written decision.
Class action waiver. You and we agree to bring claims only in an individual capacity. There will be no class action, class arbitration, or representative action. The arbitrator may not consolidate claims or preside over a class or representative proceeding. If this waiver is found unenforceable for a particular claim, that claim will proceed in court, and the rest of this section will still apply.
Opt out. You can opt out of arbitration and the class action waiver within 30 days after you first accept these terms. Send an email to legal@pineappleplaydate.com from the email on your account. Include your name, the email on the account, and a clear statement that you opt out of arbitration. Opting out does not affect the rest of these terms.
If a court finds that a part of this section cannot be enforced, the rest of this section still applies, except as the class action waiver says above.
Governing law
These terms are governed by the laws of the State of Texas, not including conflict-of-law rules. Subject to the arbitration section, courts in Texas have exclusive jurisdiction. If you live outside the United States, you may have mandatory rights under the laws of your home country. Those rights are not waived where a waiver is not allowed.
Changes
We can update these terms. The new date will show at the top of this page. If a change is material, we will post the update on this page before it applies, and we may also send a notice to the email on your account. If you keep using the service after the update applies, you accept the new terms. If you do not accept them, stop using the service and delete your account.
